So we found out via People Magazine that both Justin Timberlake and Will.I.Am are being sued for their song “Damn Girl”. The lawsuit according to People states that the song is way too similar in sound to a 1969 song “A New Day Is Here At Last” written by Perry Kibble and performed by J.D. Davis. The lawsuit is being pursued by the PK Music Performance group.
We had a chance to listen to both songs and we have to admit that they are similar. Did they sample or still the content? Or, is this just a coincidence? Or, are they just mimicking the sounds and style?
As we learn from the Pharrell Williams and Robin Thicke lawsuit with Marvin Gaye’s family, simply using a style or sound is grounds for a copyright infringement lawsuit.
